There10Mishnah Baba Batra 2:1. The adobe wall is either common property of the landlord and his neighbor or totally the neighbor’s; the landlord is required to take all necessary precautions to avoid damage to his fellow man’s property., we have stated: “One keeps seeds, the plough, and urine three hand-breadths away from a wall.” Rebbi Jeremiah said that Rebbi Ḥama bar Uqba raised a question: There11“There” means Kilaim and “here” refers to Baba Batra. It is possible that this paragraph is copied here from a Tiberian version of Baba Batra that has not come down to us. In the transmitted Caesarean version of Baba Batra (2:1, fol. 13b), the statement of R. Yose refers to the prohibition of storing salt or quick lime near somebody else’s wall. R. Simson reads “here” for “there” but it is not clear whether this is a genuine reading or an adaptation for the purposes of his commentary.
The argument is that crop plants are allowed to be grown near a buried vine; their roots are not supposed to expand over the buried shoot, but since they are not allowed to be grown near a wall, one expects their roots to expand sideways and damage the wall., you say that the roots do not expand sideways and here you say, the roots do expand sideways! Rebbi Yose said, in both cases the roots do not expand sideways but they create soft earth and undermine the base of the wall12In Babli Baba Batra 19b, the printed editions quote the statement of R. Yose as “R. Ḥaga in the name of R. Yose.” This version is impossible since R. Ḥaga (Ḥaggai) was older than R. Yose and a greater authority in his lifetime. One has to prefer the reading of all mss. (Diqduqe Soferim Baba Bathra p. מה) “R. Ḥana”. In that case, “R. Yose” would probably be R. Yasa (Assi).. You can see that because we also stated “urine”. Does urine expand sideways? Rebbi Yose the son of Rebbi Abun explained, did we not also state “the plough”? Does the plough expand sideways?

It was stated: If he provined with permission7Of the owner of the lot on which the original vine stood or into which the new vine is drawn., he brings and makes the declaration. Rebbi Yose in the name of Rebbi Ammi: Only if the permission was permanent, not temporary. Rebbi Jonah in the name of Rebbi Ammi: Even temporary. The force of Rebbi Jonah comes from the following8Mishnah Baba Batra 2:12. If somebody digs a cistern on his own property and in digging he comes upon roots from a neighbor’s tree, he may cut off these roots and keep the wood of the roots. In the Yerushalmi, Baba Batra 2:12, R. Assi in the name of R. Joḥanan holds that (invisible) roots do not influence the rules of First Fruits.: “If somebody digs a cistern, a ditch, or a cave, he may cut down as he works and the wood is his.” Is the wood not as if temporary? What does Rebbi Yose do with this? Roots always regrow; since roots do regrow it is as if permanent. Rebbi Mana said, the statement of Rebbi Joḥanan supports my father9R. Jonah., as Rebbi Joḥanan said in all cases they judged by the rules of robbers. In our case, if he gave permission to provine even temporarily, the proviner is not a robber10First fruits can always be brought if the farmer does not make illegitimate use of public or other people’s private property..

It is forbidden to store away in anything which one has to distance from a wall25Mishnah Bava Batra 2:1. Any chemically active material cannot be stored close to a wall shared with another owner.. Rebbi Yose said, since we have stated that one may store away in straw, it follows that one need not distance it from a wall. Rebbi Ḥaggai objected: Was it not stated, one who rents o house from his neighbor may not use it as storage for produce? Why? Not because of the chaff? Rebbi Ḥanania said, because of the rats. Rebbi Phineas ben Rebbi Ḥanina said, if it were because of the rats then even a storage for anything. Rebbi Shammai objected, does one not distance rocks from the wall? Then rocks are forbidden to hide away in. Rebbi Yose said, it is not that rocks produce heat but they become rusty and destroy the bottom of the wall26Bava Batra 2:1, Note 12.. But was it not stated: One does not store away in stones. Explain it for silver ore. There are Tannaim who state, one does store in rocks, and there are Tannaim who state, one does not store. Rav Ḥisda said, he who says “one stores”, with gold or brass ore; he who says “one does not store”, with silver ore27Quoted Tosaphot Bava Batra 17a s.v.סלעים..
